Three Cheers for Mark Levin

I’ve long admired Mark Levin – his sharp mind, passion and ferocious commitment to constitutional government resonate with me. Besides, he rants better than any talk show host I’ve ever heard. Mark is, of course, the founder of the Landmark Legal Foundation, which is a public interest law firm that undertakes litigation in defense of limited government.

Mark has been quite outspoken in his opposition to and contempt for the so-called Slaughter Rule by which the House would deem the Senate version of ObamaCare as passed without an actual vote. And he’s announced that should the House use the Slaughter Rule to pass ObamaCare, Landmark will immediately file an action to enjoin implementation of ObamaCare and for a declaration that its passage violated Article I, Section 7 of the US Constitution.

Landmark has already prepared a lawsuit that will be filed in federal court the moment the House acts. Such a brazen violation of the core functions of Congress simply cannot be ignored. Article I, Section 7 of the Constitution is clear respecting the manner in which a bill becomes law. Members are required to vote on this bill, not claim they did when they didn’t. The Speaker of the House and her lieutenants are temporary custodians of congressional authority. They are not empowered to do permanent violence to our Constitution.
